Terms of Service

Effective May 28, 2026.

HOA Board Minutes ("the Service") is operated by HOA Fiscal and Dynamite Management. By creating an account or using the Service, you agree to the terms below. If you do not agree, please don't use the Service.

1. Eligibility & accounts

You must be at least 18 years old and authorized to act on behalf of any association you create or join in the Service. You're responsible for everything that happens under your account, including keeping your password secure.

2. Your content

You retain ownership of the meeting agendas, minutes, attachments, and other data you upload. You grant us a limited license to store and display that content solely to operate the Service for you. We don't share your content with other tenants or third parties except as required to run the Service (e.g. cloud storage providers) or by law.

3. Acceptable use

You agree not to:

  • Upload malware, illegal content, or content infringing on third-party rights.
  • Attempt to access another association's data, bypass authentication, or probe for vulnerabilities.
  • Use the Service to send spam or harass anyone.
  • Resell or sublicense access without our written permission.

4. Service availability

We aim to keep the Service running, but we make no guarantee of uninterrupted availability. We may schedule maintenance, push updates, or briefly take features offline without notice. Critical outages we will communicate via email when feasible.

5. Your responsibility to back up approved minutes

You are solely responsible for keeping your own backup copies of any meeting minutes, agendas, and attachments that you consider official or required for your association's records.

While we use durable cloud storage (Azure Blob Storage and a managed Postgres database) and take reasonable steps to preserve your data, no service is immune to loss. You should:

  • Export each approved meeting using the "Export minutes" or "Export minutes + files" buttons and save the file in your own records.
  • Keep a printed or PDF copy of any minutes adopted by formal board vote.
  • Treat the Service as a working tool, not as the sole archival system for your association.

If your data is ever lost or corrupted, our liability is limited as described in Section 8.

6. Pricing & cancellation

Basic single-association access is currently offered free of charge. Multi-association management, white-label, and dedicated-support tiers are available through HOA Fiscal — contact us at info@hoafiscal.com. You may cancel your account at any time by contacting us.

7. Termination

We may suspend or terminate your account for violation of these terms, prolonged inactivity, or to comply with law. If we terminate without cause, we will give you a reasonable opportunity to export your data.

8. Disclaimer & limitation of liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, HOA Fiscal, Dynamite Management, and our affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption arising out of your use of the Service. Our total aggregate liability for any claim is limited to the fees you paid us in the 12 months preceding the claim, or $100 if no fees were paid.

9. Changes

We may update these terms occasionally. When we do, the "Effective" date at the top changes and we'll notify active users by email or an in-app banner. Continued use of the Service after changes means you accept them.
